LoJack Canada Enterprises ULC est une entreprise œuvrant dans le domaine des systèmes de protection antivol et de repérage de véhicules. Le 25 mai 2020, elle avisait ses clients qu’elle ne fournirait plus les services de localisation de véhicules volés à compter du 30 juin 2020. Toutefois, l’entreprise n’a offert aucun remboursement à ses clients alors qu’elle a mis fin unilatéralement à ses obligations contractuelles.
Dans la Demande pour autorisation d’exercer une action collective déposée le 20 août 2020, le requérant reproche à LoJack Canada d’avoir utilisé une pratique de commerce illégale et une politique contrevenant aux obligations d’un prestataire de services lors d’une résiliation unilatérale d’un contrat de service, et d’avoir ainsi contrevenu à diverses dispositions de la Loi sur la protection du consommateur et du Code civil du Québec.
Les membres du groupe sont décrits comme suit :
« Toutes les personnes physiques et morales domiciliées ou ayant été domiciliées au Québec et n’ayant pas été remboursées des avances versées à la défenderesse en excédent des services réellement fournis à la suite de la résiliation de leur contrat de service à durée déterminée et à exécution successive par la défenderesse le 30 juin 2020 ».

Entente approuvée ! Période de réclamation
Le 6 juillet 2026, la Cour supérieure du Québec a approuvé l’Entente de règlement intervenue dans le cadre de cette action collective.
La période de réclamation débutera le 14 septembre 2026 et prendra fin le 12 janvier 2027.

LoJack Canada Enterprises ULC is a company working in the field of anti-theft protection and vehicle tracking systems. On May 25, 2020, it notified its customers that it would no longer provide stolen vehicle tracking services as of June 30, 2020. However, the company did not offer any reimbursement to its customers while unilaterally terminating its contractual obligations.
In the Application for authorization to institute a class action filed on August 20, 2020, the applicant accuses LoJack Canada of having used an illegal trade practice and a policy contrary to the obligations of a service provider during a unilateral termination of a service contract, and thus having violated various provisions of the Consumer Protection Act and the Civil Code of Québec.
The members of the class action are described as follows:
“All natural and legal persons domiciled or having been domiciled in Québec and who have not been reimbursed for advances paid to the defendant in excess of the services actually provided following the termination of their fixed-term service contract and sequential performance by the defendant on June 30, 2020."

Settlement approuved ! Claims period
On July 6, 2026, the Superior Court of Québec approved the Settlement Agreement reached in this class action.
The claims period will begin on September 14, 2026, and will end on January 12, 2027.
